FCRA Advisory Services
Foreign Contribution Regulation Act 2010, (FCRA) was enacted with an objective to regulate the acceptance and usage of foreign contribution by organizations. FCRA registration is required by NGOs carrying charitable, religious, or social welfare activities for receiving foreign funds. This contribution received by such organizations can be one time or regular. For one time contribution, the NGO shall seek the permission under FCRA to receive the amount. For receiving regular or multiple contributions permanent registration with Ministry of Home Affairs is advisable.
An NGO active for at least three years after its registration can make an application for FCRA registration. The NGOs registered under FCRA need to open and maintain a separate bank for foreign contributions, submit a return with the ministry by 31 July every year, and maintain an audited state of accounts to avoid penalties. Such organizations should also inform the Ministry about any changes in the registered office, objects, or members within 30 days of the applicable change.
