A trademark is a word, phrase, sign, symbol or any combination thereof that can be used to identify or distinguish goods or services provided by different traders. A visual mark is applied on the goods to enable consumers recognize a brand name. Trademark registration is required for a company to create a unique brand identity in the market. Though the registration of Trademark is not mandatory but a registered trademark can protect brand (or “mark”) by restricting other people from using it.
The registration of a trademark is governed by the Indian Trade Marks Act, 1999 and application for the same is filled in form TM-1 with the trademark registry, which passes through certain checks and either accepts or objects. In case of objection, a reply is required to be filled for objection. After following the complete procedure for the registration of the trademark, the trademark registry if finds the application is in accordance with the Act issues trademark registration certificate. The duration of registration of a trademark is 10 years, after which it can be renewed from time to time.
